    Eligibility Requirements

    In California, Penal Code 1203.4 allows individuals who have successfully completed probation to petition the court to have their conviction dismissed.

    You have completed all terms of your probation.
    You are not currently serving a sentence for any offense.
    You are not currently charged with a new criminal offense.
    Your conviction was for a misdemeanor or certain felonies.

    Even if you didn't have probation

    If you were not given probation, you may still be eligible to apply for expungement one year after your conviction date, provided you have complied with all court orders.
